U.S. Crypto Regulatory Guidance Set to Take Effect Monday Next Week, Industry Poised to Enter "Clear Rules" New Phase
According to Forbes, the cryptocurrency asset regulatory guidance jointly released by the U.S. SEC and CFTC was formally submitted to the Federal Register on March 20 (this Friday) and is expected to be officially published and take effect immediately on March 23 (Monday next week).
This document will provide crypto market participants with directly actionable regulatory guidance, marking the official end of the previous ambiguous phase of "enforcement as regulation" in U.S. crypto oversight and entrance into a new stage of clarified rules.
This guidance document will comprehensively replace the "Digital Asset 'Investment Contract' Analysis Framework" released in 2019, while providing clear direction for the enforcement and daily regulatory work of both the SEC and CFTC.
According to reports, the document is based on Project Crypto launched in 2025, jointly promoted by the two major regulatory agencies, with the core objective of establishing a unified cryptocurrency asset classification system through coordinated regulatory authority.
It is worth noting that the guidance document not only provides clear direction for industry conduct, judicial analysis, and enforcement policies, but also provides immediate compliance guidance for entrepreneurs and investors, carrying greater authority than previous staff-level guidance.
The document will also classify crypto assets into five major categories, clarifying the regulatory attribution of different assets such as digital commodities and digital securities, while delineating the compliance boundaries for common crypto activities such as mining, staking, and airdrops.
The establishment of this classification system will remove core obstacles for institutional entry and industry compliance innovation. As the guidance document officially takes effect next week, the U.S. crypto industry is poised to enter a new era with clearer rules and more predictable regulation.
