As of November 11, 2025, a new bill discussion draft submitted by Senator John Boozman (R-AR) and Cory Booker (D-NJ) in the 119th Congress aims to bring the spot market for digital assets under the oversight of the Commodity Futures Trading Commission (CFTC). The draft grants CFTC broad authority by regulating the offering and sale of digital commodities (digital commodities); it defines concepts such as blockchain, DeFi, and DAO, strengthens customer protections, and increases the agency's resources.
This draft serves as an updated version of the Digital Commodities Consumer Protection Act of 2022 and provides a more robust framework by learning from the FTX collapse (American Ag Network, 2025).
Boozman stated, "CFTC is the right agency to regulate spot digital commodity trading; this draft will promote innovation while protecting consumers" (Cointelegraph, 2025). Booker emphasized new protections for retail customers and market integrity.
The proposal largely resolves the SEC-CFTC jurisdictional conflict in favor of the CFTC, classifying most assets such as Bitcoin and Ether as commodities; it has been positively received by the sector.
This development marks a critical turning point in making the U.S. a crypto capital alongside the Trump administration, strengthening the likelihood of legalization by the end of 2025 or early 2026.
